These Terms of Service (“Terms”) govern your use of the Cyfonix website and your relationship with Cyfonix Private Limited (“Cyfonix”, “we”, “us”) regarding our software products and professional services. By accessing our website or engaging with us, you agree to these Terms.
Products and services
Cyfonix provides digital forensics software (including DFL 360 and Packet 360) and professional digital forensics and incident response services. Specific product features, deployment models, service scope, and deliverables are defined in your order form, licence agreement, statement of work, or other written agreement with Cyfonix.
In the event of conflict between these Terms and a signed agreement between you and Cyfonix, the signed agreement prevails.
Licence and acceptable use
Our software is licensed, not sold. You may use Cyfonix software only in accordance with your licence terms, applicable law, and authorised forensic or investigative processes. You may not reverse engineer, sublicense, or redistribute the software except as expressly permitted in writing.
Professional services
DFIR and related services are provided on the basis agreed in your engagement letter or statement of work. You are responsible for providing lawful authority to collect, process, and analyse data, and for obtaining any consents or court orders required for the engagement.
Forensic output and legal use
Cyfonix software and services are designed to produce structured, documented, court-ready output — including chain-of-custody records, audit trails, and reports intended to support compliance with requirements such as Section 65B of the Indian Evidence Act and the Bharatiya Sakshya Adhiniyam, 2024 (BSA 2024).
Admissibility of electronic evidence is determined by courts and tribunals, not by software. Cyfonix does not warrant that any output will be admitted in any particular proceeding. You remain responsible for how evidence is collected, preserved, analysed, and presented.
Disclaimer of warranties
Except as expressly stated in a signed agreement, our website, software, and services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Cyfonix disclaims all implied warranties, including merchantability and fitness for a particular purpose.
Limitation of liability
To the fullest extent permitted by applicable law, Cyfonix shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or business opportunity. Our aggregate liability arising out of or relating to these Terms or your use of our products and services shall not exceed the fees paid by you to Cyfonix for the relevant product or service in the twelve (12) months preceding the claim, unless otherwise stated in a signed agreement.
Intellectual property
Cyfonix retains all rights in its software, documentation, branding, and website content. No rights are granted except as expressly set out in your licence or service agreement.
Third-party tools and data
Forensic workflows may involve third-party acquisition tools, capture formats, or infrastructure. Cyfonix is not responsible for third-party products or services except where expressly agreed in writing.
Governing law
These Terms are governed by the laws of India. Courts in Ahmedabad, Gujarat shall have exclusive jurisdiction, subject to any alternate dispute-resolution mechanism agreed in a signed contract.
Changes
We may update these Terms from time to time. Continued use of our website after changes constitutes acceptance of the updated Terms.
